Welcome to Alert Me (the “App”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of our mobile application and any related services (collectively, the “Service”). By downloading, installing or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Use of the Service
The Service provides subscription-based features including alerts, insights, real-time notifications, and data analytics. You must be at least 13 years old (or the minimum age in your jurisdiction) to use the Service. If you are under the required age, you may not use the App.
2. Subscription Terms
The App offers an auto-renewing subscription (“Premium Subscription”) via the Apple App Store. The terms of your subscription (title, length, pricing) are clearly displayed within the App and managed by your Apple ID. You authorize us to charge you via Apple’s mechanisms until cancelled. To cancel, use your Apple ID subscription settings at least 24 hours before the renewal date.
3. Your Account & Payment
- You are responsible for maintaining your Apple ID, credentials, and device access.
- We do not guarantee uninterrupted availability of the Service.
- You are responsible for any taxes or fees associated with your subscription.
4. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes or in violation of any local, state, national or international law.
- Reverse engineer, decompile, or attempt to extract the source code of the App.
- Transmit any viruses, worms or malicious code.
- Interfere with or circumvent any security or authentication mechanisms.
- Use the Service in any manner that could damage, disable or overburden our infrastructure.
5. Intellectual Property
All content, features, and functionality of the Service (including but not limited to text, graphics, logos, icons, software) are the exclusive property of Alert Me or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.
6. Third-Party Services & Content
The Service may integrate or link to third-party APIs, data providers, or external websites. We do not assume responsibility for third-party content, practices, or availability and encourage you to review their terms and privacy policies.
7. Disclaimers & Limitation of Liability
The Service is provided “as is” and “as available”. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to performance, accuracy, reliability or fitness for a particular purpose.
To the fullest extent permitted by law, Alert Me and its affiliates shall not be liable for any indirect, incidental, special, consequential or punitive damages (including loss of profits, data or goodwill) arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
8. Termination
We reserve the right, at our sole discretion, to suspend or terminate your access to the Service at any time and without notice, if you violate these Terms. Upon termination, your subscription will be cancelled and you will lose access to Premium features.
9. Governing Law & Dispute Resolution
These Terms are governed by the laws of the state of Massachusetts, U.S.A., without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Massachusetts.
10. Changes to Terms
We may modify these Terms from time to time. If we do, we will update the “Effective Date” at the top and post the revised Terms here. Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
